Terms of Service

These Terms of Service (“Terms”) govern your access to and use of freetinypng.org and all tools and content available on it (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

FreeTinyPNG provides free, browser-based tools for compressing and converting image files, along with editorial content related to web image optimization. All image processing happens locally in your browser; we do not host or process your files on our servers.

2. License to use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or commercial purposes, subject to these Terms and applicable law.

You agree not to:

Copy, modify, or create derivative works of the Service except as expressly permitted.
Reverse-engineer or decompile the Service for the purpose of building a competing product.
Use the Service to process content that is illegal, infringing, harmful, or that you do not have the right to process.
Attempt to interfere with the operation of the Service, including by injecting malicious code, performing denial-of-service attacks, or scraping content at a rate that degrades performance for other users.
Misrepresent your identity or affiliation, or use the Service to impersonate any other person or entity.

3. Your content

You retain all rights to the images and other files you process with the Service. Because all processing happens locally in your browser, we do not receive, store, or have any rights to your files.

You are solely responsible for ensuring that you have the legal right to process the files you upload into the tool, and for complying with any applicable copyright, trademark, privacy, or other laws.

4. Intellectual property

The Service, including its design, code, text, graphics, logos, and other content (excluding your files), is the property of FreeTinyPNG or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right or license to use any of our trademarks, logos, or other proprietary content except as strictly necessary to use the Service.

5. Third-party content and services

The Service may contain links to or embed content from third-party websites and services (for example, advertising networks). We do not control those third parties and are not responsible for their content, practices, or policies. Your interactions with third parties are governed by their terms and privacy policies, not ours.

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure.
The results obtained from using the Service will be accurate or reliable for any specific purpose.
Any errors in the Service will be corrected.

You use the Service at your own risk. Always keep backups of important image files before processing them with any tool, including ours.

7. Limitation of liability

To the fullest extent permitted by law, FreeTinyPNG and its operators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for any claim arising out of or related to the Service exceed fifty United States dollars (USD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless FreeTinyPNG, its operators, contributors, and affiliates from any claim, demand, damage, loss, or expense (including reasonable attorneys’ fees) arising out of: (a) your use or misuse of the Service; (b) your violation of these Terms; or © your violation of any third-party right, including intellectual property or privacy rights.

9. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

10. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including if we reasonably believe you have violated these Terms. The provisions that, by their nature, should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

11. Governing law

These Terms are governed by and construed in accordance with the laws applicable to internet publishers operating internationally, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved through good-faith negotiation; if not resolved within 60 days, by binding arbitration in a forum mutually agreed upon by the parties, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the latest revision. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, your sole remedy is to stop using the Service.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
